A natureza econômica do direito e dos tribunais

Resumen


Este artigo explora a natureza econômica do direito e dos tribunais como uma explicação para o problema endêmico de congestionamento judicial. A teoria econômica de bens e serviços é usada para demonstrar que o direito como coerção é um bem de clube, os tribu-nais são bens privados e ambos são bens complementares. Esses resultados são usados para mostrar que as políticas tradicionais de acesso irrestrito à justiça transformam a natureza econômica dos tribunais de bem privado em recurso comum o que gera congestionamento. Tal congestionamento natural decorrente do livre acesso ao sistema pode levar à negativa de acesso efetivo aos direitos, a Tragédia do Judiciário.
